🎯 Simple summary: This piano app is provided "as is" for educational and entertainment purposes. We are not responsible for any technical issues, hearing damage from high volume, copyright infringement from recordings you create, or downtime of third-party soundfont servers. Use common sense, protect your ears, and enjoy making music!

1. 🎧 No Warranty & "As Is" Provision

Pro Piano Ultra is provided strictly on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding:

  • The availability, reliability, or uninterrupted operation of the App.
  • The accuracy of sound reproduction, latency, or compatibility with all devices, browsers, or operating systems.
  • The absence of bugs, errors, or security vulnerabilities (though we strive for high quality).
  • The completeness of instrument samples or suitability for professional recording projects.

You assume all risks associated with using the App. No advice or information, whether oral or written, obtained from the developer or through the App shall create any warranty not expressly stated herein.

2. 🔊 Volume & Hearing Safety Warning (Important!)

⚠️ MAXIMUM VOLUME MODE – HEARING PROTECTION ADVISORY

This piano features a master volume boost designed for powerful, expressive playing. Prolonged exposure to high sound pressure levels can cause permanent hearing damage. You are solely responsible for adjusting your system volume, speaker levels, and headphone output to safe levels.

  • 🎧 If using headphones, start at the lowest volume and gradually increase to a comfortable level.
  • 🔊 When using external speakers, be mindful of your environment and others nearby.
  • 🚸 Supervise children using the App to ensure they do not expose themselves to excessive volume.
  • 🩺 If you experience ringing in your ears, dizziness, or discomfort, discontinue use immediately and consult a medical professional.

THE DEVELOPER SHALL NOT BE LIABLE FOR ANY HEARING LOSS, TINNITUS, OR RELATED INJURIES RESULTING FROM USE OF THE APP. You assume full responsibility for your listening habits.

3. 🎼 Third-Party SoundFonts & External Resources

Pro Piano Ultra relies on audio samples provided by the MIDI.js SoundFonts project, hosted at:

These soundfonts are open-source and licensed under the MIT License. However, the availability, latency, and reliability of external CDN servers are beyond our control. We do not guarantee that the soundfont repository will remain accessible, error-free, or free from unexpected changes. The App may fail to load instruments if the external host is down or modifies its file structure.

Additionally, we are not responsible for any intellectual property disputes regarding the underlying soundfont samples. The FluidR3_GM collection is widely used under permissive licensing, but users should refer to the original repository for license details. Credit and license information are provided below and in the footer of the App.

4. 🎤 User-Generated Recordings & Copyright Responsibility

The built-in audio recorder allows you to capture your piano performances as WebM files. You are solely responsible for the content you record and any subsequent sharing or distribution. This includes, but is not limited to:

  • Ensuring you have the necessary rights or licenses to perform and record copyrighted musical compositions.
  • Obtaining permission from rights holders if you share recordings publicly (e.g., on YouTube, SoundCloud, or social media).
  • Complying with all applicable copyright laws in your jurisdiction.

The App does not upload, host, or store your recordings on any server. Therefore, we have no ability to monitor or control how you use your recordings. We disclaim any liability for copyright infringement claims arising from your use of the recording feature.

🎵 Fair use reminder: Playing and recording short excerpts for personal practice is generally acceptable, but distributing full covers of copyrighted songs may require a mechanical license. When in doubt, consult a legal professional.

5. 💻 Technical Limitations & Device Compatibility

Web-based audio applications depend on your browser's implementation of the Web Audio API, hardware acceleration, and available system resources. Factors that may affect performance include:

  • Processor speed and available RAM (especially when many notes are played simultaneously).
  • Browser type and version (Chrome, Firefox, Edge, Safari, etc.) — we recommend the latest version of Chrome or Firefox for optimal audio latency.
  • Audio driver settings and external sound card compatibility.
  • Network bandwidth (for loading soundfont samples). The first load of an instrument may take a few seconds depending on your internet connection.

We do not guarantee that the App will function flawlessly on all devices, particularly older hardware or niche browsers. You accept that occasional glitches, pops, clicks, or latency may occur.

6. 🧠 No Medical or Therapeutic Advice

While making music can be enjoyable and potentially therapeutic, Pro Piano Ultra is not a medical device and does not provide any form of medical diagnosis, treatment, or therapy. It is not intended to replace professional advice for conditions such as:

  • Hearing disorders or tinnitus.
  • Repetitive strain injuries, carpal tunnel syndrome, or other musculoskeletal conditions.
  • Cognitive or neurological conditions.

If you experience pain, discomfort, or any health issues while using the App, discontinue use and consult a qualified healthcare professional.

7. 🚫 No Professional Music Endorsement

References to specific instrument names (e.g., "Acoustic Grand Piano", "Rhodes EP", "Violin", "Trumpet") are for descriptive purposes only. They do not imply endorsement, sponsorship, or affiliation with any real-world instrument manufacturer, trademark holder, or artist. The sound quality is generated by sample-based synthesis and may not perfectly replicate acoustic instruments.

Any "glow modes", "EQ presets", or "instrument names" are creative labels and should not be interpreted as professional audio engineering certifications or guarantees of specific tonal characteristics.

8. 🔄 Modifications & Service Interruptions

We reserve the right to modify, update, or temporarily suspend the App for maintenance, bug fixes, or feature improvements at any time without prior notice. We are not liable for any inconvenience, loss of unsaved settings, or inability to access the App during such periods.

If the App becomes unavailable due to technical failures, cyberattacks, or events beyond our reasonable control (force majeure), we disclaim any responsibility for resulting damages.

9. ⚖️ Jurisdiction & Legal Limitations

This disclaimer shall be governed by and construed in accordance with the laws of the developer's jurisdiction (EU / international principles). If any provision of this disclaimer is found to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.
